I just got some Weightwatchers toffee yogurts and they should have been eaten by 30th december.


I am so going to enjoy complaining to Tesco tomorrow. I shopped online and they delivered out of date yogurts.


Was thinking of pretending i had eaten one and been up all night with stomach ache....start the new year with a claim for compensation.

Paulham - what do you think about this one?? Have Tesco broken the Food and Drugs Act (Does it still exist???)??

That's very bad lou. WW yogurts usually have a life span of about 2 weeks before the BB date.

If it is a "use by" date on them, then it is a strict offence and they CAN be prosecuted for it. You will thus have a BIG bargaining tool if you threaten to take to your local EH dept.


If it is a long life product with a "best before" date then an offence is only committed IF the product is "not of the nature, substance or quality demanded by the consumer" i.e. it is off. It is not an offence simply to sell past a "best before" date.


The legislation is the Food Safety Act 1990. Food and Drugs!? We aren't in America you know!

Sorry! I am going back a long time - In the 1970s I used to work in retail management and I am sure we had a Food and Drugs Act - perhaps the Food Safety Act replaced it??

PS - We also had to know the Offices, Shops and Railway Premises Act back to front!!

Instead of a 'use by' date or a 'best before' date it would make sense to have an 'ill by' date.  This way there would be no confusion.  This would be particularly good for chicken and cream cakes.

If it was some little 'everything for 10p' shop selling an out of date bottle of pop, I'd say don't bother complaining, but with a big company like Tesco (and a product like yoghurt which really is date sensitive) definitely complain - my dad got a hamper once from Cross and Blackwell after he found a dead bee in his apple chutney!
